Deferred Disposition / Driver’s Safety Course

For the Deferred Disposition and/or The Defensive Driving Course you MUST provide the following:

  • A plea of Guilty or No Contest (Click here for Plea Form)
  • A color copy of your Driver’s License
  • A paper copy of your vehicle Insurance

Deferred Disposition

The court offers a 90-day deferred disposition. Requests for deferred disposition must be made on or before your appearance date. A plea of guilty or no contest will be entered. The payment of court cost ($120 or $145 in a school zone), payment of fine (mph over X $7 or $8 if in school zone) plus a $50.00 special expense fee must be paid. If you complete the required terms, the case is dismissed at the end of a 90-day period.

You are not eligible for a deferred disposition in the following instances:

  • Speeding 25 miles or more over the posted speed limit
  • If you held a CDL at the time the offense was committed
  • If you are charged with an offense in a construction zone

State-mandated additions:

  • If you are 25 years and under and have requested Deferred you MUST complete a DSC with a $10 administration fee.
  • If you are 17 years and under and carry a provisional driver’s license you MUST complete a driving examination provided by DPS. Whether you have previously completed the exam or not.

Driver’s Safety Course (DSC)

If you are charged with a traffic violation under Subtitle C of the Transportation Code, you may be eligible to take a driver’s safety course to dismiss the charge. Requests for driver’s safety course must be made on or before your appearance date. The court cost fees ($129 or $154 in a school zone) must be paid prior to taking the course. Also, current proof of financial responsibility and a current Texas driver’s license or active duty military ID must have presented to the court.

You are not eligible for a driver’s safety course in the following instances:

  • Fail to give information at an accident or left the scene of an accident
  • Passed a school bus
  • Committed an offense in a construction zone while workers were present
  • Speeding 25 miles or more over the speed limit
  • If you held a CDL at the time the offense was committed
  • Have not completed a driver’s safety course for the dismissal of a citation within the previous 12 months
